Welcome to TopiBowl! These Terms and Conditions ("Terms") govern your use of the TopiBowl mobile application (the "App") and our website located at https://www.topibowl.com/ (the "Website"). The App and Website are collectively referred to as the "Services." Please read these Terms carefully before using our Services.
By downloading, accessing, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use our Services. These Terms constitute a legally binding agreement between you and Dimitar Kolarov ("we," "us," or "our").
TopiBowl provides informational content about dog food recipes, nutritional values, and general knowledge for dog nutrition. The information provided is for educational purposes only.
IMPORTANT DISCLAIMER: The Services are not a substitute for professional veterinary advice. Always consult with a qualified veterinarian regarding your pet's health, dietary needs, and any medical conditions. We are not veterinary professionals and do not provide veterinary or medical advice.
a. Subscription Plans: The App offers premium features available through monthly and yearly subscription plans. The features and pricing for each plan will be detailed within the App at the time of purchase. Prices may vary by region or country.
b. Free Trial: We offer a one-month free trial for new users. This trial period may be extended for promotional purposes. At the end of the trial period, your subscription will automatically begin, and your payment method will be charged unless you cancel beforehand.
c. Billing and Payment: All payments, billing, cancellations, and refunds for subscriptions are processed by Apple via the App Store. Your subscription will automatically renew at the end of each billing cycle unless you cancel it.
d. Cancellation: You may cancel your subscription at any time through your Apple App Store account settings. To avoid being charged for the next billing cycle, you must cancel your subscription at least 24 hours before the renewal date. Upon cancellation, you will continue to have access to the premium features until the end of your current billing period.
e. Price Changes: All price changes are managed by Apple through App Store Connect.
The App is designed to protect your privacy. Most of your personal data, including information about your pet, is stored privately on your device and backed up to your personal iCloud account. We do not create or store user accounts on our servers. Your submission of personal information is governed by our Privacy Policy.
a. Custom Food Data: The App allows you to create and submit information about custom foods ("User Content"). By submitting User Content, you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, copy, modify, and distribute this anonymized data to improve our food database and the overall user experience of the Services. You are solely responsible for the User Content you submit.
b. Feedback and Comments: If you send creative ideas, suggestions, feedback, testimonials, proposals, or other materials to us, whether online or by email (collectively, "Comments"), you agree that we may, at any time and without restriction, edit, copy, publish, distribute, translate, and otherwise use in any medium any Comments that you forward to us. We are under no obligation (1) to maintain any Comments in confidence; (2) to pay compensation for any Comments; or (3) to respond to any Comments.
All materials within the Services, including, but not limited to, text, graphics, images, logos, software, and the overall design and arrangement of the App and Website, are the property of Dimitar Kolarov and are protected by copyright, trademark, and other intellectual property laws. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Services for your own personal, non-commercial use, subject to these Terms.
The Services may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for examining or evaluating the content or accuracy of, and we do not warrant and will not have any liability or responsibility for, any third-party materials or websites. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review the third-party's policies and practices carefully before you engage in any transaction.
In addition to other prohibitions in these Terms, you are prohibited from using the Services or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to violate any international or local regulations, rules, or laws; (d) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (e) to harass, abuse, insult, harm, defame, slander, intimidate, or discriminate; (f) to submit false or misleading information; (g) to upload or transmit viruses or any other type of malicious code; (h) to collect or track the personal information of others; (i) for any obscene or immoral purpose; or (j) to interfere with or circumvent the security features of the Service. We reserve the right to terminate your use of the Service for violating any of the prohibited uses.
You must be 17 years of age or older to use the Services. By using the Services, you represent and warrant that you meet this age requirement.
Occasionally there may be information in the Services that contains typographical errors, inaccuracies, or omissions that may relate to service descriptions, pricing, or promotions. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information if any information in the Service is inaccurate at any time without prior notice.
a. No Veterinary Advice: The information provided through the Services is for general informational purposes only. It is not intended as, and should not be considered, a substitute for professional veterinary advice, diagnosis, or treatment. You are solely responsible for all decisions you make regarding your pet's health and diet.
b. User Responsibility: You assume all risks and responsibility for the meals you prepare using information from the Services. This includes ensuring the quality, safety, and suitability of ingredients for your specific pet. We are not responsible for any adverse reactions, illness, or other issues that may result from the use of information provided by the Services.
c. No Warranty: The Services are provided "as is" and "as available" without any warranties of any kind, express or implied. We do not guarantee, represent, or warrant that your use of our Service will be uninterrupted, timely, secure, or error-free. You expressly agree that your use of, or inability to use, the Service is at your sole risk.
d. Limitation of Liability: To the fullest extent permitted by applicable law, in no event shall Dimitar Kolarov be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; or (iii) unauthorized access, use, or alteration of your transmissions or content.
In the event that any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
You acknowledge that these Terms are between you and Dimitar Kolarov and not with Apple. Apple is not responsible for the App or its content. Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the App.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Bulgaria, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located in Sofia, Bulgaria to resolve any legal matter arising from these Terms.
We reserve the right to modify these Terms at any time. If we make changes, we will notify you by revising the "Last Updated" date at the top of these Terms and, in some cases, we may provide you with additional notice (such as by adding a statement to our homepage or sending you a notification). Your continued use of the Services after any modification constitutes your acceptance of the new Terms.
